TERMS & CONDITIONS

1. Acceptance of These Terms

By accessing or using Arnold’s Painting (“Company”, “we”, “us”) websites, quotes, forms, or services, you (“Client”, “you”) agree to these Terms & Conditions (“T&C”). If you don’t agree, do not use the site or hire our services.

3. Scope of Services

We provide residential and commercial painting and related services (interior/exterior painting, cabinet refinishing, deck/fence staining, minor surface repairs). Exact scope, materials, prep, start date, and price are defined in your written estimate/contract (“Proposal”). If there’s a conflict, the Proposal controls project specifics.

4. Estimates, Quotes & Online Bookings
    •    Estimates are free (unless stated) and valid for 30 days.
    •    Online bookings are requests only; dates are confirmed after deposit and written approval.
    •    Pricing may adjust if site conditions differ from what was disclosed/observed.

5. Pricing, Deposits & Payments
    •    A non-refundable deposit of 30% secures scheduling.
    •    Balance is due at substantial completion unless otherwise stated.
    •    Accepted payments: cash, check, ACH, credit/debit (fees may apply).
    •    Late balances incur 1.5%/month interest (or the max allowed by law) plus collection and attorney fees.

6. Change Orders & Extras

Work not listed in the Proposal (extra rooms, unforeseen repairs, color changes after purchase) requires a written Change Order. Extra work is billed at current rates or a mutually agreed lump sum—no work proceeds without written approval.

7. Cancellations, Rescheduling & Delays
    •    Cancelling within 7 days of the start date may forfeit the deposit and mobilization costs.
    •    Weather/supply issues can shift timelines; we’ll reschedule ASAP.
    •    If the Client delays more than 30 days after deposit, pricing/material availability may change.

8. Client Responsibilities & Site Access
    •    Provide safe access during agreed hours.
    •    Remove fragile items and clear walls/furniture unless moving/covering is included.
    •    Disclose hazards (lead, asbestos, mold, pets, alarms).
    •    Water and power must be available on-site.

9. Surface Prep, Materials & Warranty
    •    Standard prep: light sanding, filling nail holes/cracks, caulking gaps. Larger repairs are extra.
    •    Premium paints (Sherwin-Williams, Benjamin Moore, or equivalent) used unless specified.
    •    Warranty: Labor/workmanship warranted for ___ months interiors and ___ months exteriors against peeling/blistering due to our application. Normal wear, moisture intrusion, structural movement, or client-supplied paint are excluded. Claims must be in writing within 10 days of discovery.

10. Color Approval & Samples

Client approves final colors. We can apply samples (fees may apply). Changes after purchase are Change Orders.

11. Photos & Marketing Use

Unless you opt out in writing, you allow us to photograph completed areas and use images (without personal data) in our portfolio, website, and marketing.

12. Promotions & Coupons

Discounts must be presented before signing the Proposal and can’t be combined unless noted. Gift cards are non-refundable and expire as required by law.

13. Website Content & IP

All site content (text, graphics, photos, code) is owned by or licensed to Arnold’s Painting and protected by law. Do not copy or reuse without permission.

14. Prohibited Uses

You agree not to hack, inject malware, scrape data, impersonate others, or submit false information through our site/forms.

15. Third-Party Links

Linked third-party sites are not under our control. We’re not responsible for their content, terms, or privacy practices.

16. Website Warranty Disclaimer

The website and content are provided “as is,” without warranties of any kind, express or implied.

17. Limitation of Liability

To the fullest extent allowed, we’re not liable for indirect, incidental, or consequential damages from site use or services. Our total liability for any project-related claim is limited to the amount you paid for that project.

18. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these T&C or misuse of the site/services.

19. Governing Law & Disputes

These T&C are governed by Missouri law. Disputes will first be addressed in good-faith negotiation; unresolved matters go to binding arbitration in Jackson County, MO under AAA rules (unless prohibited). You waive jury trial rights to the extent permitted.

20. Termination / Suspension

We may suspend site access or cancel a project for non-payment, safety issues, or breach of these T&C/Proposal. You remain responsible for amounts due through the termination date.

21. Changes to Terms

We may update these T&C anytime. Revised terms are effective upon posting. Continued use means you accept them.
